DATA PROTECTION INFORMATION NOTICE

1. Introduction

1.1. Below we inform you about the data control and processing carried out by metaloBox Kft.

1.2. metaloBox Kft. (H-8000 Székesfehérvár, Had u. 1-3., Hungary, hereafter: Service Provider, Controller), as Controller, regards the content of this information notice (hereafter: Notice) as binding upon itself. Controller guarantees that all data processing carried out in connection with its activities complies with the expectations defined in this Notice and in the regulations in    force.

1.3. metaloBox Kft. reserves the right to amend this Notice at any time.

1.5. This Notice contains essential information about the processing of your personal data. By providing your personal data, you accept the conditions contained in this Notice. Please read the Data Protection Information Notice regularly, as any changes automatically apply to the processing of the personal data you provided, even if an earlier Notice was in force at the time you provided your personal data. Any amendments to our Data Protection Information Notice will be published on our websites. Kindly read with particular attention the points highlighted in bold in this Notice, as they may contain significant conditions regarding the processing of your personal data.

If data processing takes place on any of our websites, by using the Website you accept the terms of this Notice, regardless of whether or not you register on the Website.

1.7. This Data Protection Information Notice applies exclusively to the personal data of data subjects who are natural persons, as the data of legal persons and of other undertakings  established as legal persons are not classified as personal data.

3. Basic information

3.1. The primary legal basis for the data processing carried out by metaloBox Kft. (hereafter: metaloBox) is the voluntary consent of the Data Subject. In the case of processing based on consent, the Data Subject has the right to withdraw consent at any time, which, however, does not affect the legality of processing carried out prior to the withdrawal of consent.

3.2. The Data Subject is liable for the truth and accuracy of personal data they provide. metaloBox do not check the truth of personal data provided. metaloBox is not liable for the processing of false or inaccurate data provided by the Data Subject, nor for any damage affecting the Data Subject or any third party arising from processing false or inaccurate data provided by the Data Subject. Further, metaloBox is not liable in cases where metaloBox is misled concerning the legal capacity of the Data Subject.

3.3. Giving consent

a)     On the Website, consent is given when registering on the Website or providing personal data in any other way.

b)     In every other case, consent is given via any other means verifiable by the Data Subject (on paper, in writing, by email, by fax, though video and/or sound recording etc.).

3.4. In the case of a minor Data Subject under the age of 14 years and without legal capacity, personal data can only be provided on behalf of the Data Subject by the legal representative of the Data Subject. The legal representative must make a declaration when providing the personal data of a User without legal capacity. The signed declaration must be delivered to metaloBox in person, by post, email or fax, or by other verifiable means (e.g. video and/or sound recording).

3.5. In the case of a minor Data Subject who has not yet reached the age of 16 years with limited legal capacity, their legal representative must make a declaration consenting to the processing of the minor’s personal data.

3.6. In the case of a minor Data Subject who has reached the age of 16, the agreement or approval of their legal representative is not required to validate their declaration confirming consent to the processing of their data (i.e. registration or providing personal data in any other way). Such a Data Subject may consent to data processing according to the method by which the data are provided.

3.7. With regard to the personal data communicated, made public, or provided by the Data Subject or their legal representative on the Website, the consent of the Data Subject must be regarded as given.

3.8. The personal data provided to metaloBox – unless required otherwise by legal regulation – will be processed only for the purposes stated in this Notice, to the extent and for the duration  required to fulfil those purposes.

3.9. metaloBox does not perform profiling.

4. TYPES OF DATA PROCESSING

a) SALES OF metaloBox PRODUCTS

Data Subjects: Natural persons and companies purchasing metaloBox products

Purposes of processing: To conclude contracts for products sold by metaloBox to the Data Subject and to perform tasks associated with fulfilling the contracts (e.g. delivery, invoicing etc.).         
To fulfil legal obligations related to issuing and retaining invoices

Data processed: Name*, company details*, address*, telephone number*, names of ordered products*, and technical information related to delivering the ordered products (e.g. customer number, name of ordered products, amount of subscriber fee, post box availability etc.)

Legal basis for processing: Fulfilment of contract.
Fulfilling legal obligations related to issuing and retaining accounting documents

 Sales contracts and invoices: 8 years following termination of subscription, in line with the legal obligation to retain accounting documents, but unless consent is given, metaloBox will not use these data for any other purpose.

Other: Data marked with a * above must be given in order to conclude a contract. If any of these data are not given, metaloBox cannot conclude a subscriber contract with you or provide any other services.

b) OPERATION AND USE OF WEBSITE, REGISTRATION, SERVICES AVAILABLE WITH REGISTRATION, PURCHASING FROM THE WEBSHOP

Data Subjects: Persons visiting the metaloBox Websites and placing orders there, customers of products available in the webshop

Purposes of processing: To operate the services available on the Websites, to create registrations, to identify users, to facilitate purchases

Data processed: Name*, email address*, company details*, telephone number*, other personal data provided by the Data Subject while using the Website (depending on the nature of the  Website)

Duration of processing: Registration or content provided by the Data Subject: until deleted by the Data Subject or until withdrawal of consent. If the Data Subject consented to direct  marketing communications, see sections j) and k) below.

Other: Data marked with a * above must be given in order to place an order and to have a catalogue sent. If any of these data are not given, you cannot place an order or request a  catalogue.

c) NEWSLETTERS

Data Subjects: Persons subscribing to the newsletters of our various websites

Purposes of processing: To send emails with information on the content that appears on the Website

Data Subjects: Persons who, through various channels (e.g. when concluding a contract, during a telemarketing call etc.), gave consent for their data to be used for direct marketing  purposes and direct communications of this kind.
Persons who have had contractual relations with metaloBox

Purposes of processing: To carry out direct marketing communications: information on metaloBox products, services, special offers. In the case of persons who have had contractual relations with metaloBox: to promote products and services similar to those purchased or used by the Data Subject

metaloBox provides the option to opt out (unsubscribe), such that if the Data Subject requests not to receive direct marketing communications from metaloBox, their data will be erased and not used for this purpose.

e) INFORMATION FROM metaloBox ABOUT ITS SERVICES

Data Subjects: Persons using metaloBox services

Purposes of processing: To maintain contact in relation to the services provided by metaloBox and to the fulfilment of contractual obligations

Other: This type of processing includes sending notices (system messages and information notices), by email, telephone or in writing, about essential information related to the provision of metaloBox services, and as long as the service is used, it is not possible to opt out or unsubscribe from receiving such messages.

f) OTHER COMMUNICATIONS, HANDLING COMPLAINTS

Data Subjects: Persons contacting metaloBox or placing a complaint with metaloBox

Purposes of processing: In the case of contact initiated by the Data Subject, to process the data in accordance with the objective of the contact (e.g. to reply to incoming email messages, to deal with the complaint and give information about the measures taken etc.)

Data processed: Name, email address, telephone number, address (depending on which data are given by the Data Subject and which channel(s) are used to conduct communication)

Duration of processing: Dependent on the nature of the communication or complaint, but in every case, for at least 3 years following resolution of the complaint

g) VIDEO SURVEILLANCE

Data Subjects: Persons entering the premises of metaloBox

Purposes of processing: To protect the life and physical health of metaloBox employees and other Data Subjects
To protect and preserve the value and condition of the products, equipment, technological devices and other valuable articles, which represent a significant asset value, that are located on  the premises of the registered seat, sites and branches of metaloBox, and to protect the financial transactions and cashflow conducted there
 The video surveillance system operated for these purposes is a security technology solution that serves the prevention of accidents and of unlawful actions that may cause damage, the investigation of detected legal infringements, and the provision of evidence during authority and/or judicial proceedings.

Data processed: Facial images, behaviour observed

Legal basis for processing: Legitimate interest with regard to metaloBox employees
Consent with regard to third-party Data Subjects entering metaloBox premises, which is given when the Data Subject enters the premises. Notice of consent is provided by information signs placed on the premises.

Duration of processing: Unless used, for 2(two) weeks after the video recording is made

Recipient: In the case of misdemeanour or criminal proceedings, the authorities and courts conducting the proceedings

Other: Legitimate interest is defined here as: protection of persons and property.        
The cameras are installed in places and at viewing angles that meet the above-stated objective of protection persons and property. The cameras only record video images, and are unable to record sound.
The precise locations and functions of the cameras, the events recorded, and the viewing angle of the cameras are recorded in the metaloBox camera regulation, which may be viewed upon request when entering metaloBox premises.
The recordings may be viewed and reviewed only by metaloBox employees who have the proper authorisation.

j) “ROBINSON LIST”

Data Subjects: Persons who opt out of receiving direct marketing communications

Purposes of processing: To prevent unlawful processing operations

Data processed: Email address, telephone number, name

Legal basis for processing: Legitimate interest

Processor: metaloBox Kft.

Duration of processing: Until consent is given

Other: Legitimate interest is defined here as: the interest of metaloBox to comply with the relevant data protection and other regulations, and to satisfy the request of the Data Subject to self-determination

k) CONTACT PERSONS OF BUSINESS PARTNERS

Data Subjects: Contact persons of business partners

Purposes of processing: In order to ensure smooth and rapid communication in the course of contractual relations, metaloBox needs to know the details of contact persons representing business partners

Data processed: Name, email address, telephone number, related company name, position within company (if relevant)

Legal basis for processing: Legitimate interest

Processor: metaloBox Kft.

Duration of processing: For the duration of the contract providing the legal basis; or, if the personal data appears on the contract or on related invoices, these documents are retained by  metaloBox for 8 years, in line with accountancy laws

Other: Legitimate interest is defined here as: ensuring the communication required when fulfilling contracts concluded with third parties

5. Data Processing

5.1. The Processor means any natural or legal person or other body which processes personal data on behalf of the Controller. Data processing does not imply decision-making rights over the data: the Processor carries out the data processing decisions of the Controller.

5.2. The names and tasks of the Processors are given in the detailed information on the individual types of data processing (see section 4 above). Given that this Notice is not suitable for naming all Processors, we have briefly summarised the services provided by the Processors used by metaloBox:

a)     delivery

b)     storage operation

c)     IT support services

d)     newsletter and mass email sending services

e)     providing and monitoring business management software

f)     placing ads and forwarding them to metaloBox (external ad placement sites)

g)     traders

h)     providing and monitoring invoicing software

i)     invoicing

j)     bookkeeping

5.3. In certain cases (special offers, promotions etc.), metaloBox may use other Processors, who are named in the given conditions of participation.

5.4. The Processor cannot make substantive decisions regarding data processing, but can only process the personal data that comes to its knowledge in accordance with the provisions of metaloBox; it cannot process data for its own purposes, and it must store and retain the personal data in accordance with the provisions stated by metaloBox.

6. Data Transfer

6.1. metaloBox lists the recipients and categories of data transfers in the information on individual types of data processing.

6.2. Further, on the basis of the legitimate interests of metaloBox (e.g. to create unified, company level records for administrative purposes), personal data may be transferred to the following companies belonging to the metaloBox group:

We inform you that within the metaloBox group, the purposes and means of processing are determined by metaloBox, and accordingly, the metaloBox group constitutes a group of undertakings as defined by the GPDR, in which the controlling undertaking is metaloBox, and its controlled undertakings are the other members of the group.

6.3. The Data Subject’s personal data may be transferred to third parties who - in part or in whole - purchase a business division or service belonging to metaloBox (legal succession of Controller). In such a case, the personal data of the Data Subject stored by metaloBox may also be transferred, to the extent justified by the transaction. Such data transfer does not require the prior consent of the Data Subject, but metaloBox informs the Data Subject in advance that if the Data Subject objects to the data transfer, their data will not be forwarded.

6.4. In the case of automated data processing, the Data Subject may ask metaloBox to transfer the data, given to them by the Data Subject and processed by them on the basis of consent or fulfilment of contract, to a third-party Controller, in a structured, commonly used and machine-readable format, if this is technically possible; the Data Subject informs the recipient Controller of the data necessary to complete the data transfer. If such a data transfer request encounters obstacles, metaloBox will notify the Data Subject within a reasonable time.

6.5. metaloBox are entitled and obliged to transfer to the relevant authorities all personal data at their disposal and legally stored by them, which they are obliged to forward by law or legally binding official obligation. metaloBox cannot be held liable for such data transfers or any consequences.

7. Data Transfer to a Third Country

7.1. metaloBox does not transfer personal data to a Controller with a registered address in a Third Country (i.e. a country that is not a Member State of the EEA).

7.2. In certain cases, metaloBox may use Processors with a registered address in a Third Country. For example, mass newsletters are sent using Mailchimp, operated by The Rocket Science Group, LLC (675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308). Mailchimp operates under the legal framework of the EU-US Privacy Shield, in force since 2016, which regulates exchanges of personal data between Controllers and Processors based in the European Union and the United States of America.

8. Data Security

8.1. metaloBox ensures data security in accordance with the applicable regulations.

8.2. Among the data security measures, metaloBox, in particular, takes technical and organisational measures and establishes procedural rules that ensure that the processed data is protected against unauthorised access, alteration, transfer, disclosure, deletion, destruction, accidental destruction or damage, and also against inaccessibility due to any change in the technology used.

8.3. When defining and applying data security measures, metaloBox takes into account the latest technological developments. Among the possible data processing solutions, metaloBox chooses the solution that ensures the highest level of protection of personal data, unless this would pose a disproportionate difficulty to metaloBox. metaloBox also enforces these requirements on their Processors.

8.4. metaloBox undertakes to requires all third parties to whom the data may be forwarded or transferred to comply with the above commitments. However, in the case of legitimate data transfer by metaloBox, metaloBox is not responsible for any damage caused by the recipient.

8.5. All employees of metaloBox, on the basis of an employment contract or other legal basis, are obliged to observe the above principles on data processing and data security.

9. Rights of the Data Subject concerning the processing of personal data

9.1. Data Subjects may at any time, using the contact details given in this Notice, request information about the processing of their personal data, ask for their data to be corrected or erased and for processing of their data to be restricted, and may opt out of the processing of their data. The Data Subject also has the right to data portability.

9.2. metaloBox will inform the Data Subject without undue delay, but in any case within one month of receiving a request, of the measures taken in response to the request as laid out below. If necessary, taking into account the complexity of the request and the number of request, this deadline can be extended by an additional two months. MetaloBox will notify the Data Subject about the extension of the deadline within one month of receiving the request, giving the reasons for the delay. If the request was received electronically, the information will also be provided electronically, if possible, unless the Data Subject requests otherwise. If we consider that no measures need to be taken in response to the request, we will inform the Data Subject without delay, at the latest within one month of receiving the request, citing the reasons for taking no measures, and reminding the Data Subject of their right to file a complaint with the data protection authority and/or to appeal for judicial remedy.

9.3. Fulfilling a request is free of charge, but if a request is clearly unfounded or - especially due to repetition - excessive, metaloBox may charge a reasonable fee, reflecting the administrative costs arising from the request, or may refuse to fulfil the request.

9.4. If there is reasonable doubt concerning the identity of the Data Subject submitting the request, additional information may be requested to confirm the Data Subject’s identity.

9.5. At the request of a Data Subject, metaloBox will provide information on whether their personal data is processed; if so, the Data Subject has the right to access their personal data processed by metaloBox and to obtain information on the purposes of processing, the categories of the data concerned, the recipients or categories of recipients receiving access to the personal data, the planned duration of the processing or the criteria for determining this duration, and the source of the data.

9.6. Upon request, metaloBox will provide the Data Subject with a copy of their processed personal data. A reasonable fee, reflecting the administrative costs, may be charged for additional copies requested by the Data Subject. If the Data Subject submitted the request electronically, the information will be provided in a widely used electronic format, unless otherwise requested by the Data Subject.

9.7. The Data Subject may request the rectification of incorrect or inaccurate data and has the right to ask for missing data to be supplemented.

9.8. The Data Subject may submit a request for metaloBox to erase their personal data if

a)     the data is no longer needed to fulfil the purpose for which processing occurred;

b)     the Data Subject withdraws their consent and there is no other legal basis for processing;

c)     the conditions stated in section 9.13. exist;

d)     the data processing was unlawful;

e)     the data must be erased for metaloBox to fulfil a legal obligation,

f)     the Data Subject is a minor who has not yet reached the age of 16.

9.9. Upon receiving a request as specified above, metaloBox will erase the data unless continuing to process the data is necessary for the purpose of

a)     exercising the right to freedom of expression and information,

b)     fulfilling a legal obligation binding upon metaloBox,

c)     establishing, exercising or defending legal claims.

9.10. At the Data Subject’s request, metaloBox will restrict processing if

a)    the Data Subject disputes the accuracy of the personal data; in this case, the restriction lasts until the accuracy of the data can be checked,

b)     the Data Subject asks for processing to be restrict and not erased, even though the processing is unlawful,

c)     metaloBox no longer needs to process the data, but the Data Subject requires it for the purpose of establishing, exercising or defending legal claims,

d)     the Data Subject objected to the processing of their data as per section 9.13.; in this case, the restriction will last pending verification whether the legitimate grounds of the Controller override those of the Data Subject.

9.11. Where processing has been restricted as above, such personal data, with the exception of storage, may only be processed with the Data Subject's consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another person or for reasons of important public interest of the European Union or of a Member State. metaloBox will inform the Data Subject in advance of the lifting of the restriction.

9.12. metaloBox will communicate any rectification or erasure of personal data or restriction of processing to the Data Subject and to each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort. The controller shall inform the data subject about those recipients if the data subject requests it. Where metaloBox has made the personal data public and is obliged to erase the personal data, metaloBox, taking account of available technology and the cost of implementation, will take reasonable steps, including technical measures, to inform controllers which are processing the personal data that the Data Subject has requested the erasure by such controllers of any links to, or copy or replication of, those personal data.

9.13. The Data Subject may object to the processing of their personal data

a)     if it is based on legitimate interest; in this case, the processing cannot be continued, unless there are compelling legitimate grounds overriding the interests, rights and freedoms of the Data Subject, or unless it is justified by grounds related to establishing, exercising or defending legal claims,

b)     if it is done in the interest of, or is related to, direct marketing; in this case, processing for this purpose must be discontinued.

Sections 9.2-9.4. are also governed by the right to object.

9.14. Based on the right to data portability, the Data Subject may, firstly, receive from metaloBox the data processed by them in a structured, commonly used and machine-readable format, if this is technically possible, and forward this to any other Controller, and secondly, may ask metaloBox to transfer the data in accordance with section 6. 4..

9.15. If metaloBox does not fulfil any of the above requests by the Data Subject, they must inform the Data Subject of the reason for this at the latest within one month of receiving the request.

9.16. If the Data Subject considers that their rights over their personal data have been infringed, please send a complaint to metaloBox as any of the Contact Details below.

9.18. If you experience unlawful data processing, you can initiate a civil lawsuit. The adjudication of the lawsuit falls within the jurisdiction of the court. 10. Changes to this Data Protection Information Notice will be published on our Websites. The current Notice in force always applies to the processing of personal data, even if a different Notice was in force at the time when the data subject registered or provided personal data in another way.
